Terms of service

Last updated: 15 May 2026

1. Acceptance of terms

By creating an account or using the Ojava service (the “Service”) you agree to these Terms of Service. If you are entering into these terms on behalf of an organisation, you confirm you are authorised to bind that organisation.

2. The service

Ojava provides AI-powered cloud security monitoring for small and medium businesses. The Service is offered on a subscription basis with a 14-day free trial. Features may evolve over time; we will provide reasonable notice before removing material functionality.

3. Cybersecurity disclaimer (important)

Ojava is a security monitoring tool, not a guarantee of security. No security product, including Ojava, can detect every attack or prevent every breach.

You remain responsible for your own security posture, including access management, MFA, training your staff, and acting on the alerts that Ojava produces. Ojava's detection rules and AI explanations are decision support, not legal or compliance advice.

4. Subscription and payment

Paid plans are billed monthly in CHF by invoice. We email you a Swiss QR-Rechnung (QR-bill) PDF; you pay by bank transfer using your e-banking app. Failure to pay may result in suspension of monitoring (your data is preserved). You can cancel at any time by emailing billing@ojava.ch; cancellation takes effect at the end of the current billing period and we will not issue a further invoice.

5. Acceptable use

You agree not to: (a) use the Service to monitor accounts you do not own or are not authorised to monitor; (b) attempt to reverse engineer, scrape, or overload the Service; (c) use the Service to violate applicable law; (d) resell access to the Service without our written consent.

6. Data processing

See our Privacy policy and the Data Processing Agreement (available on request) for how we handle personal data on your behalf.

7. Limitation of liability

To the maximum extent permitted by Swiss law, Ojava's total liability for any claim arising from or related to the Service is limited to the amount you paid Ojava in the 12 months immediately preceding the event giving rise to the claim. Ojava is not liable for indirect, incidental, special, or consequential damages, including lost profits, lost data, or business interruption.

8. Indemnification

You agree to indemnify and hold Ojava harmless from any claim arising from your use of the Service in breach of these terms or in violation of applicable law.

9. Modifications

We may update these Terms with reasonable notice (typically 30 days for material changes, immediately for legal/security changes). Continued use after the effective date constitutes acceptance.

10. Governing law and jurisdiction

These Terms are governed by the laws of Switzerland. The exclusive place of jurisdiction for any dispute is the courts of the Canton of Geneva, Switzerland, subject to mandatory consumer-protection venue rules.
